E. (§19.18) Scope of Interrogatories; Contention Interrogatories; Witnesses

Rule 56.01(b)(1) provides, “Parties may obtain discovery regarding any matter, not privileged, which is relevant to the subject matter involved in the pending action . . . .” Rule 57.01(a) provides, “Interrogatories may relate to any matter that can be inquired into under Rule 56.01.”

Rule 57.01(a) also provides, “An interrogatory otherwise proper is not necessarily objectionable merely because an answer to the interrogatory involves an opinion or contention that relates to fact or the application of law to fact . . . .” These types of interrogatories are usually referred to simply as contention...
