Generally, compensation for tort damages attempts to restore the injured party to the position the party would have been in if the tort would not have been committed. Diminution of value is favored in cases of tortious damage to property. In a breach-of-contract case, the goal of compensation is to place the injured party in the position he or she would have been in had the contract been fulfilled.
