J. (§18.26) Exemplary Damages
Punitive damages are different from other damages in that their goal is not to restore the plaintiff. Rather, punitive damages are limited to the purposes of punishment and deterrence. Awards that are arbitrary violate due process. Pac. Mut. Life Ins. Co. v. Haslip, 499 U.S. 1, 19–20 (1991). Factors relevant to the reasonableness of an award include the degree of reprehensibility of the conduct and the ratio between the actual harm inflicted and the amount of punitive damages...
