c. (§18.17) Unknown or Unborn Parties

As described in §18.16 above, in judicial proceedings involving trusts or estates of decedents, the doctrine of virtual representation applies to unknown or unborn parties under § 472.300, RSMo 2000. But in a suit to construe a will that is not connected with the administration of a decedent’s estate, § 472.300 might not apply. This issue has not been authoritatively settled.
