To be a QSJT, a joint trust must be established by a married couple. That trust must establish either:
· a “true” joint trust with assets held for the benefit of both spouses and which is amendable and revocable by both spouses acting together; or
· a “tax planning” joint trust in which two independent shares of the trust are created with one held for the benefit of each spouse with that spouse having the power to revoke or amend the provisions of that spouse’s share.
