Section 17 Statute of Limitations for Loss of a Chance

The statute of limitations applicable to a survivorship action applies to a lost chance case. The court may extend the time for the appointment of a personal representative, for appointment of a plaintiff ad litem, or for the application of letters of administration as set forth in §§ 473.050 and 473.070, RSMo 2000, in medical malpractice cases when a lost chance is pled. See, e.g., Kemp v. Balboa, 959 S.W.2d 116, 119 (Mo. App. E.D. 1997); Johnson v. Akers, 9 S.W.3d 608 (Mo. banc 2000).
