The statute of limitations for tort actions generally is § 516.120, RSMo 2000, which is a five-year statute. There is an important distinction between a statute of limitation and a statute of repose. A statute of limitation governs the time within which legal proceedings must be brought or commenced after the cause of action accrues; a statute of repose limits the time within which an action can be brought, and its application is not contingent on the accrual of the cause of action.
