Section 17 Enforcement of Discovery

If, in the discovery phase of proceedings, a party objects to providing information or producing particular documents, the issue is initially put to the PSC in the context of a motion to compel. The PSC rule regarding discovery requires counsel to confer and, if that is not successful in resolving the dispute, to engage the presiding officer in a telephone conference regarding the discovery dispute before filing a written motion to compel. 4 CSR 240‑2.090(8).
