When a nonmerit agency fails to adopt substantially similar appeal procedures for dismissal, the agency has, by default, adopted the procedures provided for merit system employees. Laws v. Sec’y of State, 895 S.W.2d 43 (Mo. App. W.D. 1995). At the time of the Laws decision, those procedures were found in § 36.390.5, RSMo, as it appeared before amendment by House Bill 1868, 95th General Assembly, Second Regular Session (Mo. 2010), effective August 28, 2010.
