No violations of the duty of fair representation were found in the following cases:

  • Bodecker v. Local Union No. P-46, 640 F.2d 182 (8th Cir. 1981) (no duty of fair representation violation in failing to fully disclose terms of contract amendments or in telling employees that employer would close operations if contract not amended)
  • Hamilton v. Consolidated Freightways, 612 F.2d 343 (8th Cir. 1979) (no violation for union to delay handling of warning letters until employee is suspended or discharged...
