Section 536.063, RSMo 2000, calls for initiation of a contested case by filing a writing in which the party or agency seeks
some action that by law may be taken only after a hearing
or that seeks a hearing to obtain a decision reviewable on
the record. Stipulations and agreements may not be used to initiate a contested case. State ex rel. Sierra Club v. Mo. Pub. Serv. Comm’n, No. WD 66893, 2007 WL 581652 (Mo. App. W.D. Feb. 27, 2007).
