F. (§16.33) Assumption of Risk
Restatement (Second) of Torts § 523 (1977) bars recovery for a plaintiff that assumes the risk of harm from an abnormally dangerous activity.
Comment b to § 523 states that although ordinary contributory negligence in failing to discover an abnormally dangerous activity is not a defense to strict liability, "a possessor of land who expressly agrees that the defendant may conduct blasting operations in close proximity to his land, with knowledge of the abnormal risk of harm to his person or property from the operations, can not recover when the activity miscarries and the harm results."
