VII. (§16.24) FAR Part 36 and Job Order

Contracting

Many of the federal acquisition regulations deal generically with task order contracting. But in the construction arena, utilizing job order contracting, counsel should take into account the provisions of FAR Part 36. Part 36 deals with “policies and procedures peculiar to contracting for construction and architect-engineer services. It includes requirements for using certain clauses and standard forms that apply also to contracts for dismantling, demolition, or removal of improvements.” FAR 36.000.

When a requirement under FAR Part 36 is inconsistent with another regulation, “this Part 36 shall take precedence if the acquisition of construction or architect-engineer services is involved.” FAR 36.101(b). If an acquisition involves both construction and supplies or services, the...
