A. (§16.11) Generally

The function of a qualified expert witness is to consider facts that are related to the case in a hypothetical question and to provide a conclusion or opinion based on that information.

When an opinion is hypothetical in nature, it must not be founded on mere assumptions or surmise, but on facts within the expert’s knowledge or on hypothetical questions embracing proven facts.
