Section 15 Dual Majority Election and Declaratory Judgment

The final part of the process involves (1) a dual majority election in the annexing municipality and in the annexation area and (2) filing, as a class action against the "inhabitants" of the annexation area, a petition in circuit court for declaratory judgment authorizing the annexation. Adoption of the annexation ordinance and concomitant filing of the declaratory judgment action may occur either before or after the dual election.
