Section 15 Authority to Consent

The person must have the authority to consent to the treatment. If the patient is an adult—a person who is age 18 years or older—the patient has the legal authority to consent to any personal treatment. This includes the right to refuse any treatment. If the patient has been declared incapacitated by a court and a guardian is appointed for the patient, the guardian may make treatment decisions for the patient. Section 475.120.3, RSMo 2000. If the patient has executed a durable power of attorney for health care, the authority of the agent to make health care treatment decisions becomes effective when two physicians certify that the patient lacks decision-making capacity.
