The Don’ts of Closing Argument

1. Don’t come off as a “wimp”:

a. Don’t “thank the jury for serving.” Instead, commend them for their hard work, commitment, and importance to this trial and the overall judicial system.

b. Never apologize!

2. Don’t turn off or bore the jury:

a. by reciting what each witness said; or

b. by using legalese or legal terms that the jury will not understand.

3. Don’t go over the top with dramatics:

a. Don’t finger point.

b. Don’t pound on the lectern.
