III. (§15.3) Disincorporation

There are statutory procedures for the disincorporation of:

· cities of the third class (§§ 77.700–77.715, RSMo 2016);
· cities of the fourth class (§§ 79.490–79.540, RSMo 2016);
· villages (§§ 80.570–80.670, RSMo 2016); and
· constitutional charter and home rule cities (§§ 82.133–82.148, RSMo 2016).

The county governing body shall disincorporate a third class, a fourth class, or a constitutional charter or home rule city upon:

the filing of a petition of 25% of the city’s voters (§ 1.035, RSMo 2016, provides that “[w]henever the word ‘voter’ is used in the laws of this state it shall mean registered voter, or legal voter”);
an election following publication of notice for four successive weeks; and
