M. (§15.29) Ownership Interest of Third Parties and Joinder

When third parties claim an interest in marital assets, they may and should be joined in the divorce case so that the interests of all the owners are protected. Ravenscroft v. Ravenscroft, 585 S.W.2d 270 (Mo. App. W.D. 1979), disapproved of on other grounds by Hoffmann v. Hoffmann, 676 S.W.2d 817, 824–25 (Mo. banc 1984). When there is no title interest but there remains an issue as to whether a third party has an interest in property, an attempt should still be made to join the third party.
