VIII. (§15.15) Claims

Claims are obligations (liabilities) of the minor protectee that arise either before or after the issuance of letters. Claims include expenses of adjudication and administration, but the latter are treated differently. Section 475.010(2), RSMo (H.B. 154, 95^th Gen. Assembly, 1^st Reg. Sess. (Mo. 2009)). Claims do not include disputes or demands regarding title of the protectee to specific items of property alleged to be included in the estate (those items that would fall under a discovery-of-assets procedure). Id. There is no time limitation for the filing of claims against a minor’s estate except for the general statutes of limitations.

Claims are filed with the court (there is no provision in Chapter 475, RSMo, that allows for the payment of consented claims as there is in the probate provisions of Chapters 473 and 474, RSMo, under §...
