D. (§15.13) Annual Reports and Settlements
Every year, the guardian and conservator must file an annual report with the court. Section 475.082.2, RSMo 2000. The purpose of this report is twofold:
1. It lets the court know the status of the guardianship or conservatorship and whether the incapacity or disability has ceased (if the guardianship or conservatorship continues).
2. It assures the court that the fiduciary is discharging the fiduciary’s responsibilities and duties as imposed by Chapter 475, RSMo, Probate Code—Guardianship.
Some feel that, because of the incapacity and disability language of the first condition, this reporting requirement does not apply to minor guardianships because once the minor reaches 18 years of age, the proceedings terminate. See 3 John A. Borron, Jr., Missouri Practice, Probate Forms Manual Form 4.93 cmt. (1997).
