A. (§15.10) Guardian

The guardian of a minor is entitled to the custody and control of the ward and must provide for the ward’s education, support, and maintenance. Section 475.120.1, RSMo 2000. But the guardian is not obligated to use the guardian’s own resources to provide education, support, or maintenance. Section 475.120.4. On the other hand, if the guardian uses their own funds to support the minor without the intent of being reimbursed, the guardian cannot later come to court and ask for reimbursement. State ex rel. Strickland v. Strickland’s Adm’r, 80 Mo. App. 401 (W.D. 1899).

Section 475.120.3 does enumerate some general guidelines, but the overriding standard is the ward’s best interest. Those guidelines are as follows:

(1) Assure that the ward resides in the best and least restrictive setting reasonably available;

(2) Assure that the ward receives medical care and other services that are needed;
