NLRA § 8(b)(2) makes it an unfair labor practice for a union to cause or attempt to cause an employer to discriminate against an employee in violation of NLRA § 8(a)(3), 29 U.S.C. § 158(a)(3), or for a union to discriminate against an employee whose membership in the union has been denied or terminated for grounds other than failure to pay union dues or fees required as a condition of employment. 29 U.S.C. § 158(b)(2).
