Because § 536.087, RSMo 2000, is patterned after the EAJA, some courts have looked to federal cases construing the EAJA for guidance when there is no state case on point. St. Joseph State Hosp. v. Soliday, 861 S.W.2d 145, 147 (Mo. App. W.D. 1993), overturned on other grounds, Dishman v. Joseph, 14 S.W.3d 709 (Mo. App. W.D. 2000); see also White v. Mo. Veterinary Med. Bd., 906 S.W.2d 753 (Mo. App. W.D. 1995).
