Rule 128.01 gives both the juvenile and the custodian the right to be present at all times during any hearing, but Rule 128.01.b provides that a hearing may be held without the juvenile if the juvenile’s presence is waived by counsel or, in the case of a detention hearing, if the court finds that the juvenile’s presence “is not warranted.”

The juvenile’s custodian may be excluded, in the court’s discretion, at any time from any hearing if it appears to be in the juvenile’s best interest. Rule 128.01.e.
