Section 14 Right to Consent

Residents in mental health facilities and programs have the right to make informed decisions regarding medical treatment. Section 198.088.1(6)(c), RSMo 2000, provides as follows:

Each resident admitted to the facility . . . [i]s fully informed by a physician of his health and medical condition unless medically contraindicated, as documented by a physician in his . . . record, and is afforded the opportunity to participate in the planning of his total care and medical treatment and to refuse treatment, and participates in experimental research only upon his informed written consent.
