C. (§14.8) Priority to Be Named Conservator

Before appointing any other eligible person as conservator of a disabled person, a court must consider the suitability of certain classes of persons. Section 475.050.1, RSMo 2000. These preference classes are hierarchical. In re Banks, 285 S.W.3d 389, 392 (Mo. App. E.D. 2009).

The court must first consider anyone the disabled person nominates at the time of the hearing, if the disabled person is able to make and communicate a reasonable choice. Section 475.050.1.

If the disabled person is not able to make or communicate that choice, the court must consider any eligible person, organization, or corporation the disabled person nominated in a durable power of attorney or in a written instrument the disabled person and two witnesses...
