Section 14.68 Limiting the Officer to the Officer’s Report

The author would suggest that defense counsel consider questioning the arresting officer on the officer’s report in the following manner:

• You have been a police officer for x years?

• During that time you have written x number of reports?

• X number of those reports are DWI reports?

• There is a special report you make for DWI cases?

• You are familiar with this report?

• You have received training in how to write these reports?

• You understand that your reports are used in court proceedings related to a DWI investigation?

• You know the prosecuting attorney will receive a copy of...
