2. (§14.64) Possession of Burglar’s Tools

See § 569.180, RSMo 2000. Defense of a charge of possession of burglar’s tools may go to:

· the purpose for which the tools were possessed, State v. Medley, 232 S.W.2d 519 (Mo. 1950);

· the lack of possession by the defendant;

· the claim that they are not burglar’s tools. But see State v. Hefflin, 89 S.W.2d 938, 103 A.L.R. 1301 (Mo. 1936); or

· the claim that the defendant is not a burglar.
