L. (§14.40) News Reporter Privilege

The U.S. Supreme Court has held that a reporter has no privilege granted by the United States Constitution to refuse to divulge a confidential source when required to do so before a grand jury in criminal proceedings. Branzburg v. Hayes, 408 U.S. 665 (1972). The United States Court of Appeals for the Eighth Circuit has allowed that there may be some protection against compulsory disclosure of news sources, Cervantes v. Time, Inc., 464 F.2d 986, 995 (8^th Cir. 1972)...
