1. (§14.3) Generally

Quo warranto protects the public from usurpers into franchises granted by the state. The action tries the issue of the title of a person claiming a particular franchise and ousts those whose claims are found not to be legal. That franchise may be the right to hold public office, the right to exercise certain powers within that office, the right to a public or private corporate franchise, or the right to exercise powers within the franchise.
