A. (§14.25) Generally

Section 531.050, RSMo 2000, provides for judgment in quo warranto, and judgments in both ex officio and private relator cases follow this pattern. The statute provides that, if the respondent “shall be adjudged guilty of any usurpation of, or intrusion into, or unlawfully holding and executing any office or franchise,” the court may render judgment of ouster and a fine against the respondent and may also award a judgment for costs to the relator.
