N. (§14.23) Misdirection of Jury by Court

Misdirection of the jury is usually based on the fact that the court erroneously admitted or denied certain evidence or gave or refused to give certain jury instructions. A new trial should be granted for erroneous admission of evidence only when the evidence has harmed the party who claims error. Rol Miller & Sons, Inc. v. Schultz Prods. Co., 418 S.W.2d 721, 723 (Mo.
