B. (§14.21) Rules of Evidence

Because quo warranto is a civil action at law, the normal rules of evidence prevail. But because there is no jury and because the court or the master hearing the evidence, or both, can disregard any evidence ultimately found to be inadmissible, it is often the practice to receive the evidence, subject to a later ruling on its admissibility, or to receive it as an offer of proof.
