B. (§14.17) Absence of Defendant as a Tolling Factor

Section 516.200, RSMo 2000, formerly provided that the statute of limitations was tolled against a Missouri-resident defendant who "depart[ed] from and reside[d] out of this state" after the cause of action accrued. This statute was declared unconstitutional in State ex rel. Bloomquist v. Schneider, 244 S.W.3d 139, 141–43 (Mo. banc 2008).
