The legislature has attached a great deal of significance to the nature of the alleged offense in the overall picture of whether to dismiss a petition to allow prosecution under the general law. This factor is addressed by § 211.071.6(1), (2), and (3), RSMo Supp. 2010.
The courts have similarly emphasized the significance of the nature of the alleged offense. In State v. Tate, 637 S.W.2d 67, 71 (Mo. App. E.D. 1982), the court stated that “the seriousness, and particularly the violent or vicious nature of the crime may constitute strong evidence that the juvenile is not a fit subject for the rehabilitative facilities of the juvenile court.”
