Section 13 Human Immunodeficiency Virus

There are Missouri laws imposing a duty on persons who have the human immunodeficiency virus (HIV) that causes acquired immunodeficiency syndrome (AIDS). These persons shall disclose this information to any health care professional from whom the person receives health care services before receiving services. Section 191.656.5, RSMo Supp. 2005. It is also unlawful for an individual infected with HIV to expose another person without the knowledge and consent of that person to be exposed to HIV through contact with blood, semen, or vaginal fluid in the course of oral, anal, or vaginal sexual intercourse or by the sharing of needles. Section 191.677.1(2), RSMo Supp. 2005.

Physicians, health care providers, and laboratories must report positive HIV test results with the patient’s identity to the Missouri Department of Health and Senior Services. Section 191.653.3, RSMo 2000. A health care facility must notify funeral establishment personnel, coroners, or medical examiners who are handling a patient who is HIV infected.
