The employer has certain responsibilities in the administration
of leaves under the FMLA. For example, the employer is permitted to calculate the available 12 weeks of leave by calendar year, any fixed 12-month period (such as fiscal year or employee’s anniversary), or 12 months forward or backward from the date leave begins. 29 C.F.R. § 825.200(b).
