E. (§13.77) Obstructions on Public Sidewalks
A municipality’s obligation to keep its public ways in a reasonably safe condition not only applies to the presence of ice and snow and structural defects, but it also extends to other obstructions. Likewise, if an abutting property owner causes an obstruction on a public way or by special use of a public way renders it not reasonably safe, the abutting landowner can be held responsible for a pedestrian’s injury. The following cases aptly demonstrate these principles.
