1. (§13.6) Statutes Authorizing Mandamus as a Remedy

The clearest case for mandamus relief is when a statute specifically provides that a writ of mandamus may be issued to enforce its provisions. The most common examples are statutes that provide that mandamus is available to compel a governmental authority to pay bonds that it has issued or to make other payments (such as payments to a retirement fund). See, e.g., §§ 91.740, 173.405, 257.400, 305.317, 305.535, RSMo 2000 (payment of bonds); § 70.735, RSMo 2000 (payments to retirement funds).
