E. (§13.39) Beneficiary Deed of Gift or Bill of Sale

Section 461.026, RSMo 2000, provides for the beneficiary transfer of tangible personal property. This procedure may be used as the nonprobate transfer equivalent of the “list” that may be authorized by will under § 474.333, RSMo 2000. It is also used to transfer cattle, growing crops, and farm machinery, in conjunction with a beneficiary deed to agricultural property.

The requirements are that the instrument must:

expressly state that the transfer is not to take effect until the death of the owner;

be “in other respects”—i.e., other than the deferral of the effective date—sufficient to transfer the type of property...
