U. (§13.23) Golden Rule Argument

One form of argument frequently attempted in personal injury actions is that in which counsel urges the jury to place itself in the position of a party. This type of argument, commonly known as the “golden rule” argument, is forbidden. Fisher v. Williams, 327 S.W.2d 256 (Mo. 1959); Kelsey v. Kelsey, 329 S.W.2d 272 (Mo. App. E.D. 1959).
