a. (§13.20) Alarm

To successfully establish a claim of stalking against a respondent, the petitioner must prove that the petitioner was “alarmed” by the respondent’s conduct. Alarmed, as defined in§ 455.010(13)(a), RSMo Supp. 2011, requires the respondent to have caused “fear of danger of physical harm.” The petitioner must establish that not only does the petitioner have actual fear of danger of physical harm but that the fear is reasonable.
