N. (§13.16) Insurance

When insurance exists only to indemnify one of the parties in the event that the party is found liable for damages, it must not be mentioned in argument. See Collins v. Nelson, 410 S.W.2d 570 (Mo. App. S.D. 1965); N. County Sch. Dist. R-1 v. Fid. & Deposit Co. of Md., 539 S.W.2d 469 (Mo. App. E.D. 1976). Cf.Steinlage v. Marchetto, 659 S.W.2d 292 (Mo. App. E.D. 1983). The court found that the plaintiff’s counsel erred when referring to the fact that a third party would pay any judgment awarded, inferring that the defendant had no interest in the case. Mock v. J.W.
