6. (§13.15) Special Relationships

A special relationship was found in Keenan v. Miriam Foundation, 784 S.W.2d 298 (Mo. App. E.D. 1990), when the plaintiff, bringing donated merchandise to a not-for-profit corporation, expressed concern about driving to the back lot because of the neighborhood, but the defendant’s employee told her that there would be somebody with her. An employee unlocked, but did not close, the gate to the barbed-wire cyclone fence which enclosed the back lot. The plaintiff was left alone on the lot for five or ten minutes while the defendant’s employees carried boxes of donated items from her car to the shop...
