Consistent with other environmental laws, violations of the CWA, or orders or permits issued under it, are subject to civil penalties of up to $37,500 per day, per violation. 33 U.S.C. § 1319; 40 C.F.R. § 19.4. See:

· United States v. Allegheny Ludlum Corp., 366 F.3d 164 (3^rd Cir. 2004) (district court should calculate economic benefit of violations)

· Chevron, U.S.A., Inc. v. Yost, 919 F.2d 27 (5^th Cir. 1990) (assessing liability for an oil spill despite the fact that no actual injury occurred)

· United States v. Tex-Tow, Inc., 589 F.2d 1310 (7^th Cir. 1978) (imposing strict liability on offenders)

Penalties are assessed in accordance with the factors set forth in 33 U.S.C. § 1319(d).
