Official Form 5, see §12.38 of the Missouri Bankruptcy Practice (MoBar 2nd ed. 2007) deskbook, now includes an unsworn declaration, which 28 U.S.C. § 1746 permits instead of verification, for the petitioning creditor’s signature. But to the extent that an attorney is executing the Official Form 5 on behalf of the creditor, the attorney would be well advised to have, in the file, a verification from the creditor and authorization to proceed on the creditor’s behalf.
