C. (§12.32) Notice of Acceleration

A contractor’s decision to accelerate is often motivated by a desire to complete on schedule to avoid liquidated damages. Faced with that situation, a contractor must determine if the costs of acceleration will exceed the costs it faces in liquidated or other damages that the owner may assert against it if it does not complete on time.
