2. (§12.25) Predissolution Abuse or Neglect

Another evidentiary issue involved in child abuse or neglect cases is whether counsel may present evidence at the modification hearing of abuse or neglect that occurred before the dissolution. Section 452.410.1, RSMo 2000, provides that a court may not modify a custody decree unless a change of circumstances can be shown by “facts that have arisen since the prior decree or that were unknown to the court at the time of the prior decree.”
