c. (§12.11) Proof of Prior Representations

Included below are cases that support the general rule that evidence of the making of a similar representation is not admissible to prove that a disputed representation was made:

· Bailey-Ball-Pumphrey Co. v. German, 247 S.W. 483, 484 (Mo. App. S.D. 1923). The court held that it was error to receive evidence of statements of other agents of the defendant while soliciting other business.
